Leaving the UAE? Breaking a Dubai Tenancy Contract

Last updated 5 November 2026

A job loss, relocation or family emergency can mean leaving Dubai with months left on your lease. The law is clear that the contract does not end just because your plans changed, but there are several practical, lawful ways out. Here is what Law No. 26 of 2007 actually says and how tenants usually handle it.

The starting point: no unilateral termination (Article 7)

Article 7: where a lease contract is valid, it may not be unilaterally terminated during its term by the landlord or the tenant. It can only be terminated by mutual consent or in accordance with the law.

The law does not list leaving the UAE, cancellation of a residence visa or losing your job as grounds for a tenant to end the contract. So the answer depends on two things: what your contract says, and what you can agree with the landlord.

Read Article 7 in full.

Option 1: Use the early-termination clause

Many Dubai tenancy contracts include an addendum allowing the tenant to leave early with a set notice period and a penalty (often expressed as months of rent). The law does not fix that penalty; it is a contractual term. Read your contract and addendum carefully for:

  • The notice period and how notice must be given.
  • The penalty amount and whether it replaces or adds to remaining rent.
  • What happens to the security deposit and uncashed cheques.

If the clause exists, following it exactly is usually the cleanest exit, because termination by agreed contract terms is termination by consent.

Option 2: Negotiate a mutual termination

If there is no clause, Article 7 still allows termination by mutual consent. Landlords often accept a deal, especially when given time to find a new tenant.

1
Tell the landlord early
Explain the situation and your planned departure date in writing. The more notice, the stronger your position.
2
Offer something concrete
For example, rent until a new tenant moves in, a fixed number of months, or help with viewings.
3
Put it in writing
A signed termination agreement covering the end date, the amount payable, the deposit, and which cheques are returned.
4
Close everything out
Hand over in the condition you received the property (Article 21), settle utilities and cancel the Ejari.

Option 3: Sub-let or assign, with written consent (Article 24)

Unless the contract says otherwise, a tenant may not assign the use of, or sub-let, the property to third parties without the landlord's written consent (Article 24). If the landlord agrees, a replacement occupant can take over. Without written approval, sub-letting is a ground for evicting both you and the sub-tenant (Article 25(1)(a)). If the landlord approved the sub-lease and your contract is later terminated by the Tribunal, the sub-tenant may stay on under the terms of the sub-lease (Article 30).

See Article 24 and Article 25.

Post-dated cheques

Your rent cheques are payment for the term you signed. Leaving does not cancel them. As part of any settlement, agree in writing which cheques the landlord will return or not present, and collect them before you fly. Stopping cheques without agreement can create unpaid-rent problems: Article 25(1) lets a landlord seek eviction if rent is not paid within 30 days of a notice to pay.

If you cannot agree: the Rental Disputes Centre

Disputes arising from the tenancy go to the Rental Disputes Centre (the Tribunal under the law). Note that filing an eviction claim does not stop rent from being due while the case runs (Article 31). If you are leaving soon, get advice early rather than leaving disputes open behind you.

Tip for your next lease

If your job or visa situation could change, negotiate a clear early-termination clause before signing: notice period, fixed penalty and deposit treatment. It turns a stressful exit into a simple step.

People also ask

Can I cancel my Dubai tenancy contract because I am leaving the UAE?
Not on your own. Article 7 says a valid contract cannot be unilaterally terminated during its term; it ends only by mutual consent or under the law. The law does not list leaving the country or job loss as a termination ground, so you rely on your contract's early-termination clause or an agreement with the landlord.
Is there a fixed penalty for breaking a lease in Dubai?
Law 26 of 2007 does not set a standard early-termination penalty. Any penalty, such as a number of months' rent, comes from the clause in your contract or what you negotiate with the landlord.
Can I sub-let the flat to someone else and leave?
Only with the landlord's written consent, unless the contract says otherwise (Article 24). Sub-letting without written approval is a ground for evicting both tenant and sub-tenant (Article 25(1)(a)).
What happens to my post-dated rent cheques if I leave?
The cheques are payment of rent you agreed to. Agree in writing with the landlord which cheques will be returned or cancelled as part of the settlement before you leave, and collect them. Do not simply stop them without agreement.
What if the landlord refuses any deal?
Either party can take a dispute arising from the tenancy to the Rental Disputes Centre. Unpaid rent also gives the landlord grounds to seek eviction after a 30-day notice to pay (Article 25(1)), so get legal advice before simply walking away.
