Bounced Rent Cheque in Dubai: What Happens Next for Tenants and Landlords
Last updated 25 October 2026
Most Dubai rents are still paid by post-dated cheques, so a bounced cheque is a common problem. Here's what the rental law actually allows.
The 30-day rule
Under Article 25(1) of Law 26 of 2007 (as amended), a landlord may seek eviction before the contract ends if the tenant fails to pay the rent or any part of it within 30 days after the landlord gives a notice to pay — unless the parties agreed otherwise. The notice must be given through a Notary Public or registered post.
Through a Notary Public or registered post, stating the unpaid amount.
2
Wait 30 days
If the tenant pays within 30 days, the eviction ground falls away.
3
File at the Rental Disputes Centre
For eviction and/or the unpaid rent. The tenant must keep paying rent while the case runs (Article 31).
Civil, not criminal (in most cases)
Since the UAE's 2022 commercial law reforms, a cheque returned for insufficient funds is generally pursued through civil enforcement rather than criminal charges. Fraud, forgery and similar bad-faith cases can still be criminal. Because the details depend on the facts, take legal advice before acting.
Tips for tenants
Warn the landlord in writing before the cheque date if funds will be short.
Offer a replacement cheque or bank transfer and keep proof.
Pay within the 30-day notice window to avoid an eviction ground.
Ask for monthly or quarterly cheques at renewal if 1–2 cheques are hard to cover.
Can I be evicted immediately for a bounced rent cheque in Dubai?
No. The landlord must first give a notice to pay, through a Notary Public or registered post, and may seek eviction only if the rent is not paid within 30 days of that notice, unless the contract says otherwise (Article 25(1)).
Is a bounced cheque a crime in the UAE?
Since the UAE's 2022 reforms, a cheque returned for insufficient funds is generally a civil matter; cases involving fraud, forgery or bad faith can still be criminal. Get legal advice for your specific case.
Do I still pay rent if the landlord files an eviction case?

What should a tenant do if a cheque is about to bounce?
Tell the landlord in writing before the date, offer a replacement payment or a short plan, and keep proof. Settling within the 30-day notice window avoids the eviction ground.
