Subletting your Dubai rental — to a flatmate, a friend overseas for a few months, or as an Airbnb — sits in a legal grey zone. Here's what's actually allowed under Dubai Law No. 26/2007, what requires landlord consent, and what happens if you don't get it.
What the Law Says
Dubai Law No. 26 of 2007 (as amended by Law No. 33 of 2008) is clear on subletting: it requires the landlord's written consent. Article 25(d) specifies that a tenant subletting without permission is grounds for eviction with 30 days notice.
In practice, this means subletting in Dubai is legal if and only if your landlord has given written consent — either a clause in the contract, a separate written approval, or an addendum signed during the tenancy.
Three Common Subletting Scenarios
Scenario 1: Adding a Flatmate Long-Term
If you want a flatmate to live with you and contribute to rent, the cleanest path is to add them to the contract as a co-tenant rather than sublet. This avoids the subletting question entirely. See our guide on adding a tenant to a Dubai contract.
Scenario 2: Short-Term Sublet to Airbnb
Almost universally not allowed. Beyond the standard subletting prohibition, most Dubai building bylaws explicitly forbid short-term lets, and the DTCM (Department of Tourism and Commerce Marketing) requires a holiday-home licence — which residential tenancies cannot obtain.
Scenario 3: Long-Term Sublet While Travelling
If you're going abroad for 3-12 months and want someone to occupy and pay rent, this requires written landlord consent. Some landlords accept; many don't. Easier to negotiate at signing or renewal than mid-tenancy.
Penalties for Unauthorized Subletting
- Eviction with 30 days written notice (per Article 25(d))
- Forfeiture of security deposit
- Potential claim for additional rent or damages
- Building management may impose separate fines (typically AED 5,000-50,000)
- DTCM penalty for short-term-let violations (AED 5,000-15,000+)
- Difficulty obtaining future Dubai rentals (landlords share blacklists informally)
How to Add a Subletting Clause to Your Contract
In the Additional Terms section, include a clause like:
'Tenant may sublet the property in whole or in part subject to landlord's prior written consent, which shall not be unreasonably withheld. Tenant remains liable for all obligations under this contract during any subletting period.'
Negotiate this at signing — it's much easier than retrofitting permission mid-tenancy.
